Framework Convention Protocols

The Framework Convention envisages a number of protocols dealing with the prevention, reduction and control of pollution as well as the protection, preservation and restoration of the marine environment. Under the second phase of international support to the Convention, the Caspian littoral countries have assigned priority to the following four protocols:

  • The Protocol on Land-Based Sources of Pollution;
  • The Protocol Concerning Regional Cooperation in Case of Emergency;
  • The Protocol on EIA in a Transboundary Context, and
  • The Protocol on Protection of the Caspian Biodiversity.

Development of protocols is carried out under auspices of the UNEP/ROE, which acts as Interim Secretariat of the Framework Convention, and IMO (for the protocol Concerning Regional Cooperation in Case of Emergency):

  • Three regional meetings were organized for most of protocols in period 2004 - 2006 allowing the protocol negotiations to considerably advance.
  • The Protocol Concerning Regional Cooperation in Case of Emergency was finalized and agreed upon in principle at the second expert meeting in Tehran in September 2005. It was renamed to the Protocol Concerning Regional Preparedness , Response and Cooperation in Combating Oil Pollution Incidents.
  • Noting the need to establish a regional mechanism for effective cooperation and coordination in case of major oil spills the CEP Steering Committee at its meeting held in Moscow in Decembery 2006 recommended "expediting finalization of the national approval processes of the Protocol Concerning Preparedness and Response to Oil Pollution Incidents (OPI) with a view to its signing in the near future";
  • On the same meeting SC recommended "expediting finalization of the draft protocols on environmental impact assessment in the transboundary context: biodiversity and land-based sources of pollution and activities".

Further steps on preparing the protocols for signing will be discussed at the First Conference of Parties to Framework Convention (COP I) to be held on May 23-25 in Baku, Azerbaijan.

Proposals for new protocols

The CEP Steering Committee recommended at its Almaty meeting in February 2006 "that in addition to the four protocols being presently developed consideration be given under the Convention process to develop a protocol on fisheries".
