AAA.&&& &&& &&& Skadar-Shkoder Lake Commission (SLC) 2nd Meeting Minutes of the Meeting Date and place: 23rd April 2010, Budva, Montenegro Agenda of the meeting 1. Discussion on Lake Skadar-Shkoder Integrated Ecosystem Management Project (LSIEMP) Progress (Presentation by both Project Coordinators, Agim Shimaj and Viktor Subotic) 2. Discussion on the infrastructure development in Skadar -Shkoder Lake watershed area: - Presentation of the summary of HPP "Ashta" EIA; - Presentation of current development of Moraca River dams system (SEA status); - Presentation of current status of development of Regional Watersupplying system for Montenegrin coast; - Presentation of another infrastructure development projects (if any). 3. Conducting of the wide Lake Fishery Stock Assessment (Presentation by the MN Project Coordinator) 4. Future cooperation between Ministry of Spatial Planning and Environment of Montenegro and Ministry of Environment, Forestry and Water Administration of Republic of Albania (preparation of new MoU and organization of bilateral Ministerial meeting) 5. Any other business (discussion of SLC Study visit results and lessons learned, discussion on the ToR for harmonization of legislation-inclusion of spatial planning aspectsetc.) Agenda Point 1 Both project coordinators presented current status of LSIEMP project implementation. Firstly, Agim Shimaj stated that several issues were resolved in advance of SLC meeting, namely, new Secretary of the Commission was selected, which will improve functioning of transboundary structures (Lake Commission, Working Groups). Further, structure for administration of Shkodra Lake Natural Managed Reserve is established, and it will be followed by development of Management Plan. Several joint activities are underway, such as: development of Socio-economic Assessment (in advanced stage), Public Awareness Plan and Legal Harmonization consultancy. Also, important activities are conducting regarding improved fishery management, cultural heritage revitalization (Rozafa fortress) etc. Viktor Subotic presented activities implementing in Montenegro, with main focus on National Park Skadar Lake capacities building (technical and administration capacities), KAP ecology improvement activities, Vranjina waste waters treatment facility development, as well as for cultural monument revitalization (fortification Besac). As far as joint activities are in question, special emphasizes is given to the development of Lake watershed Predictive Hydrological Model, joint Lake Monitoring program and Lake Management and zoning plan. As the main obstacle in Project implementation he pointed out weak functioning of Technical Services Unit, as procurement and financial management unit. Several observations were made on project progress report: Sajmir Hoxha expressed his view on importance for development on Lake watershed Hydrological Model, and its usage as tool for floods early warning. Ridvan Troshani noted that joint Lake management plan should also take into account floods management. Further, Zoran Mrdak proposed that LSIEMP Progress Report should include minutes of joint structures meetings. Finally, Jelena Knezevic confirmed necessity for integrated and harmonized approach for development of management instruments, with purpose of efficient protection and sustainable usage of the natural resources. Conclusion: Joint LSIEMP Progress Report was adopted by consensus. Agenda Point 2 Presentation of the summary of HPP "Ashta" EIA Sajmir Hoxha presented facts about development for HPP Ashta project on Drin River. Namely, previous project on construction of HPP Bushati was rejected after suggestions and complains from scientific and academic institutions. After that, revised project of HPP Ashta was developed. Based on relevant project documentation, including EIA, there are no significant impacts on the Lake ecosystem hydrological regime will be protected by construction on the bypass on Drin River, which will also allow migration of fish species between river and the Lake. Also, he informed Lake Commission members that actual construction of HPP Ashta started. Jelena Knezevic stated that based on the documentation provided for Lake Commission meeting: EIA main conclusions and Environment, Safety, Health and Safety Screening Report (prepared by International Financial Corporation - IFC), there are certain contradictions about possible impacts on the Lake. Also, she pointed out that EIA study for HPP Ashta was asked to be provided by Ministry of Spatial Planning and Environment, through Ministry of Foreign Affairs, but it was not realized. Also, exchange of these documentations for infrastructure development which would have transboundary environmental impacts is in accordance with provisions of ESPOO Convention. Finally, she underlined importance of development of Lake watershed Hydrological Model, as a tool for better planning and assessment of environmental impacts on Skadar-Shkoder Lake. Sajmir Hoxha noted that EIA document for HPP Ashta should be submitted to the Ministry of Spatial Planning and Environment of Montenegro, but based on the all information provided, analyzed and presented in relevant documents there are no significant impacts on the Lake ecosystem, so actual construction of the HPP Ashta is underway. Marko Junkovic stressed out that environmental impacts on Buna/Bojana River should be assessed too, since there are open issues on preservation of beaches in Buna/Bojana Delta. He noted as important that construction of HPP Ashta will allow free migration of fish species, which is important for biodiversity protection. Conclusion: Ministry of Environment, Forestry and Water Administration will submit EIA document for HPP Ashta to the Ministry of Spatial Planning and Environment, through Ministry of Foreign Affairs. Presentation of current development of Moraca River dams system (SEA status) Jelena Knezevic presented current status on development of Moraca River dams system. Namely, SEA document is developed for Detail Spatial Plan for Moraca River region which will be affected by construction of dams, public consultation process is finished and procedure for assessing of comments and suggestion by wide public is underway. Environmental Protection Agency established Commission for final assessment and eventual adoption of SEA document. Preliminarily, as main issues are recognized hydrological regime and biodiversity protection. Based on the results from ADRICOSM STAR project, impacts on hydrology are minimal, while additional researches of impacts on biodiversity will be addressed through separate studies. Also, she stated that even if it was not obligation under ESPOO Convention, Ministry of Spatial Planning and Environment sent officially SEA document to the Ministry of Environment, Forestry and Water Administration, asking for expression of interest for submitting comments and suggestions. However, prcised deadline set in official notification expired. Sajmir Hoxha stated that consultations on SEA document for Moraca River dams system in Ministry of Environment, Forestry and Water Administration are underway, and Ministry of Spatial Planning and Environment will be officially informed on the results and final decision. He pointed out that Moraca River contributing with 20% to the Lake waters, and aspects as hydrology and biodiversity should be discussed further. Jelena Knezevic confirmed that official opinion from Ministry of Environment, Forestry and Water Administration will be taken into account, but she asked that it should be presented to the Ministry of Spatial Planning and Environment in short possible time, in order to conduct all necessary procedures in planned time frame. Conclusion: Ministry of Environment, Forestry and Water Administration will sent official opinion to the Ministry of Spatial Planning and Environment in regards to the SEA document for Moraca River dams Detail Spatial Plan in due time. Presentation of current status of development of Regional Watersupplying system for Montenegrin coast Sinisa Stankovic informed Commission members about development of Regional Watersupplying system for Montenegrin coast. Namely, it is most efficient solution for resolving of permanent lack of drinking water in 6 municipalities in the coastal zone of Montenegro. The water source for the whole system is Bolje sestre in the Lake. Based on the information and conclusions from EIA document, there are no significant impacts on the Lake ecosystem. Precisely, capacities of the water source is more then 2000 l/s, while it will be extracted maximum 1500 l/s, in full capacity of the regional system, during summer peak, including projected development of tourism capacities. Sajmir Hoxha replied that since EIA document which was developed several years ago was not submitted to the Ministry of Environment, Forestry and Water Administration, it would be important to provide information for how many inhabitants regional watersupplying system is projected (permanent residents vs. tourists) as well as would there be any changes in Lake hydrology. Conclusion: Necessary information on environmental impacts from regional watersupplying system will be provided to the Commission members, as well as projections related to the number of users (tourists during summer season). Agenda point 3 After initial presentation of the legal and practical arguments for development of Lake wide Fishery Stock Assessment, as well as conclusion and agreement reached at joint Working Group on Water Management and Planning and Legal meeting held on 16th April, discussion was opened. While members of the Commission strongly supported the initiative that through LSIEMP Project stock assessment should be done, Sajmir Hoxha, also supporting the idea, stressed out that preliminarily assessment on time frame and financial resources needed for this planned activity should be done before final decision would be made. Namely, there are different opinions on the timing needed to conduct stock assessment and provide reliable data, also from institutional point of view who should do scientific work, as well as which are funds needed, methodology used and results processed. Conclusion: Lake Commission consider as necessary to conduct wide Lake Fishery Stock Assessment, taking into account that, as preconditions for final decisions, clear information on above mentioned issues should be provided. Agenda point 4 Jelena Knezevic stated that existing Memorandum of Understanding in the field of environmental protection and sustainable development principle implementation from 2003 was signed for period of 5 years. Taking into account new processes deriving from EU integration and regional cooperation, new MoU should be drafted, based on existing and established paths of very good cooperation between Montenegro and Republic of Albania. Sajmir Hoxha confirmed that level of cooperation between two respective Ministries in charge of Environment is at very satisfactory level, and it should be strengthen by signing of new Memorandum of Understanding. Conclusion: Draft of the new MoU will be prepared by representatives of Ministry of Spatial Planning and Environment of Montenegro by June 1st. It will be sent to the Ministry of Environment, Forestry and Water Administration for comments and suggestions. Final text should be prepared by July 1st, in order to determine date for signing of the Memorandum by the Ministers. Agenda point 5 In the discussion, positive comments were given to the SLC members Study visit to the Bodensee Lake in November 2009, with proposal that similar study trip should be organized this year also, in order to improve role and importance of the Skadar-Shkoder Lake Commission. Also, activities on Project visibility should be strengthened. Final conclusions are that representative of Ministry of Environment, Forestry and Water Administration will chair Lake Commission this year, as well as that next two SLC meetings will be held in Republic of Albania.
