RECOMMENDATION CONCERNING THE APPLICATION BY THE BALTIC SEA STATES OF A FORMAT FOR REPORTING DIFFICULTIES ENCOUNTERED IN THE DISPOSING OF RESIDUES AND MIXTURES CONTAINING NOXIOUS LIQUID SUBSTANCES
THE COMMISSION,
RECALLING Paragraph H of Regulation 5 of Annex IV of the Convention on the Protection of Marine Environment of the Baltic Sea Area, 1974, (Helsinki Convention), concerning the establishment of Reception Facilities in Ports for the Reception of Residues
and Mixtures Containing Noxious Liquid Substances,
RECALLING ALSO HELCOM Recommendation 3/4 concerning the application by the Baltic Sea States of the IMCO format for reporting alleged inadequacy of reception facilities for oily waste (MEPC/Circ. 60) and the application of a Helsinki Convention format for reporting alleged inadequacy of reception facilities for sewage and garbage,
NOTING that Regulation 5 of Annex IV of the Helsinki Convention will enter into force on 1 January 1986,
NOTING ALSO that reporting of difficulties encountered in the reception of residues and mixtures containing noxious liquid substances should be initiated in order to bring the Contracting Parties' attention to any such difficulty,
RECOMMENDS that Governments of the Contracting Parties to the Helsinki Convention should:
a) instruct ships flying their flag to report in accordance
with the format given in the Attachment to this Recommendation any difficulty encountered in the disposing of residues
and mixtures containing noxious liquid substances in ports of the Baltic Sea Area experienced when applying the Provisions of Regulation 5, Annex IV of the Helsinki Convention;
b) see to it that the master of the ship concerned should complete and submit, through the shipowner, to the administration the form contained in the Attachment to this Recommendation in each instance when he has experienced difficulties in disposing of residues and mixtures containing noxious liquid substances to reception facilities;
c) evaluate each report received, and where the difficulty encountered is considered justified, it should inform the Contracting Parties in question and the Secretariat of the Helsinki Commission in form of a summary report; and
d) submit, when receiving such information, comments or other information relating to the difficulties encountered, to the Secretariat of the Helsinki Commission for further transmission to the Contracting Parties.
