RECOMMENDATION CONCERNING THE APPLICATION BY THE BALTIC SEA STATES OF THE IMCO FORMAT FOR REPORTING ALLEGED INADEQUACY OF RECEPTION FACILITIES FOR OILY WASTE (MEPC/CIRC. 60) AND THE APPLICATION OF A HELSINKI CONVENTION FORMAT FOR REPORTING ALLEGED INADEQUACY OF RECEPTION FACILITIES FOR SEWAGE AND GARBAGE
THE COMMISSION,
RECALLING Paragraph E's of Regulations 4, 7 and 8 of Annex IV of the Convention on the Protection of Marine Environment of the. Baltic Sea Area, 1974, (Helsinki Convention), concerning the establishment of Reception Facilities in Ports for the Reception of Oily Residues, Sewage and Garbage,
RECOGNIZING that the Marine Environment Protection Committee (MEPC) of the Inter-Governmental Maritime Consultative Organization (IMCO) at its 8th session agreed on forms of reports on Inadequate Reception Facilities for Oily Waste,
as contained in document MEPC/Circ.60, dated 16 January 1978, for the purpose of Article VIII of the International Convention for the Prevention of Pollution of the Sea by Oil, 1954, (as amended in 1969) ,
RECOGNIZING ALSO that agreed IMCO forms of reports on Inadequate Reception Facilities for Sewage and Garbage are not available,
NOTING that HELCOM Recommendation 1/1 recommends Governments of the Contracting Parties to the Helsinki Convention-to take appropriate steps to ensure that reception facilities for oily residues and other wastes from ships are used to the fullest extent; taking into account that the cost and time factors are essential in connection with the use of reception facilities for wastes from ships-and that any measures which could provide disincentives to such use should be avoided,
NOTING ALSO that Annex IV of the Helsinki Convention entered into force for all the Contracting Parties on 3 May 1981,
NOTING FURTHER that reporting of inadequate reception facilities in relation to Regulations 4, 7 and 8 of Annex IV of the Helsinki Convention should also be initiated in order to bring the Contracting Parties' attention to any inadequacy of reception facilities for oily waste, sewage and garbage in the Baltic Sea Area,
RECOMMENDS that Governments of the Contracting Parties to the Helsinki Convention should:
a) instruct ships flying their flag to report, in accordance with the format given in document MEPC/Circ. 60, which is attached to this Recommendation as Attachment 1, any inadequacy of reception facilities for oily waste in ports of the Baltic Sea Area experienced when applying the Provisions of Regulation 4 of Annex IV of the Helsinki Convention;
b) see to it that the master of the ship concerned should complete and submit, through the shipowner, to the administration, Part I of the form which could be supported, if appropriate, by the completed form of Part II, in each instance when he has experienced difficulties in disposing of oily wastes to reception facilities;
RECOMMENDS ALSO that Governments of the Contracting Parties to the Helsinki Convention should:
c) instruct ships flying their flag to report in accordance with the format given in Attachment 2 to this Recommendation any inadequacy of reception facilities for sewage and garbage in ports of the Baltic Sea Area experienced when applying the Provisions of Regulation 7 and 8 of Annex IV of the Helsinki Convention;
d) see to it that the master of the ship concerned should complete and submit, through the shipowner, to the administration the form contained in Attachment 2 to this Recommendation in each instance when he has experienced difficulties in disposing of sewage and garbage to reception facilities;
RECOMMENDS FURTHER that Governments of the Contracting Parties to the Helsinki Convention should, in addition to the procedures laid down in MEPC/Circ. 60:
e) evaluate each report received, and where the allegation is considered justified, it should inform the Contracting Parties in question and the Secretariat of the Helsinki Commission in form of a summary report; and
f) submit, when receiving such information, comments or. other information relating to the alleged inadequacies, to the Secretariat of the Helsinki Commission for further transmission to the Contracting Parties.

THE INTERNATIONAL CONVENTION FOR THE PREVENTION OF POLLUTION OF THE SEA BY OIL, BY OIL, 1954 (AS AMENDED IN 1969)
Reports on Inadequacy of Reception Facilities for Oily Waste
Article VIII of the above Convention specifies that each Contracting Government shall take all appropriate steps to promote the provision of reception facilities of oily residues end wastes from ships, including tankers, and report to the Organization, for transmission to the Governments concerned, all cases where the facilities are alleged to be inadequate. Having considered this matter at its eighth. session (5-9 December 1977), the Marine Environment Protection Committee. agreed on the final forms of reports on inadequate reception facilities for use in the implementation of Article VIII(3) of the Convention (I=C VIII/17, Annex II). Copies of the forms, which consist of two parts, the first concerning the port aid the second concerning the reporting ship, are attached hereto. The Committee also agreed the following reporting procedure:
(a) the Secretariat should circulate to the Governments concerned the final forms approved by the Comitteè;
(b) each Government should arrange for the dissemination of the forms to shipe flying its flag;
(c) the master of the ship should complete and submit, throw the shipowner, to the Administration, Part, I of the for. which could be supported, if appropriate, by the completed form of Part II, in each instance when he has experienced difficulties in disposing of oily wastes to reception facilities;
(d) the Administration should evaluate each report received and, where in its opinion the alleged inadequacy is ju3tified, it should
inform the Secretariat in the form of a summary report submitted at the end of June and December every year; '
(e) the Secretariat should transmit the information received to the Governments concerned; and
(f) the Governments receiving such information should submit to the Organization comments or other information relating to the alleged inadequacy.
Member Governments and Governments of States, panties to the Convention, are invited to make appropriate arrangements for implementing items (b), (c)p (d) and (f ) above with regard to ships flying their flags so as to put this procedure into effect and, in particular, to use the attached forms for the purposes of paragraphs (b) and (c).
In taking this action, the Committee agreed that the above scheme should be put into operation initially, on an experimental basis, end that the forms should be reviewed at a future session with a view to their improvement in the light of experience gained. Consideration should also be given to the appropriateness of dissemination of the information received by the Secretariat to all Member Governments.
